Depending on how the lease is written, the issue of tenants' transferring their POSSESSORY RIGHTS, may fall into one of 3 categories, which I will discuss in detail in other entries. However, for now, these categories are as follows:
1- The Written Lease or oral Leasehold is silent on wether the tenant can assign or sublet their possessory rights.
2- The lease allows for subletting or assignment ONLY with the Landlord's consent.
3- The lease prohibits assignments or subletting altogether.
